Update, June 26, 2:00 a.m. EST: The livefeed of the filibuster has ended, but we now have a feed showing protesters outside the senate chamber at the Texas capitol.

Texas state Sen. Wendy Davis (D-Fort Worth) is conducting a filibuster of SB 5, which would shut down all but five abortion clinics in the state and ban abortion after 20 weeks. Davis, who is not allowed to eat, drink, lean on anything, or use the restroom during the filibuster, intends to stall the legislation until midnight tonight, when the special session of the Texas legislature ends.

    Has anyone considered that late term abortions are not necessarily for a lack of trying or Mother’s willfully delaying the procedure, but is due in fact to the barriers and delays to early and affordable access to procedures?!?

      Actually, only 2% of abortions are late term and they are usually due to issues with the fetus that cannot be tested for or detected in the first 18-20 weeks. By shortening the time frame allowed, more abortions actually occur due to uncertainty. This was argued in Georgia when our limit was reduced from 24 to 20 weeks this year. The doctors’ here testified against the bill. The Georgia bill did not include the more noxious elements (like the ambulatory medical center requirements).

      The doctors know that something is wrong, but there is no time to allow for assessment of how bad it is. Given the uncertainty, most parents opt for termination because of the expense of having a severely disabled child or because of concerns of health of the mother. For example, if the fetus is non-viable, the mother risks sepsis and infection from the dead tissue if there is a death in utero.

      Hope this helps. We have our own struggles in my state too. They tried to push for reductions in reproductive health coverage for state employees and dependents this year too. Last year, they tried to criminalize miscarriages, requiring investigations into whether they are truly spontaneous or induced.

        Criminalizing miscarriage would take us back to the late 18th and early 19th centuries when there were laws in some jurisdictions that did just that unless witnesses swore that the fetus was stillborn.           Seriously? He was tried and convicted. He is NOT representative of physicians who support abortion, whether they provide them or not. I’ve done inspections of Planned Parenthood clinics in one job (RN) and been a patient because I lost my health, work, income and health insurance due to the crash. IF women of child bearing age had better access to health care, birth control AND good sex education (men too) abortion would be cut drastically. Did you see the NYC stats?
          With the morning after pill being available OTC, it should help. Unfortunately, the cost is prohibitive for many.

His case is the reason why we need safer access to abortion care clinics because lunatics like him take advantage of low income women who have no other option on their hands. His case was absolutely horrid and you just put your own foot in your mouth by bringing that up. Reducing abortion time to 20 weeks increases the chances of getting an abortion, due to uncertainty. Reducing abortion clinics doesn’t reduce abortions, it reduces legal abortions and increases unsafe environments as more women will do them by unregistered practitioners or themselves.

          Gosnell was not a case of abortion, you troll. Gosnell delivered full term, live babies and then killed them outside of the womb. This is murder and he is a monster. However, at 20 or 24 weeks, you are not talking about babies yet because these fetuses cannot live outside the womb. I stand behind the facts that there are few of this abortions and that they are aborted for being non-viable and/or pose a threat to the mother’s life. It is a tragedy that the fetus is non-viable, but no woman should be forced to carry around a dead fetus at risk to her own life.

In fact, in some cases, making abortion illegal actually increases it’s incidence since illegal abortion is usually accompanied by a lack of access to comprehensive sex education and contraception, two practices that are known to significantly reduce abortion.

          If people are really interested in reducing abortion, they would work to legalize it so it can be provided in a safe, regulated way, and then work hard to establish broad and easy access access to contraception and evidence-based comprehensive sex education.

        Not really. There are many ways to lower the abortion rate that don’t require a law like this. Education, access to birth control, access to health care. Many take these things for granted. Pro choice people aren’t pro abortion we just have other ways to work toward ending the need for abortion that are prevented by the same guys in office trying to pass these laws. If they were willing to help low income women, they would offer low cost and free birth control plans for them, but they don’t want to help the poor do anything. It’s cognitive dissonance. Debates about abortion and abortion laws in these settings is about POWER. Because it comes down to women. What would the debate look like if laws starting getting passed forcing women to have abortions??? Food for thought.

            yah that’s not actually just “food for thought”; they’re actually successful results from reports that have tested the validity of better: sex education, access to birth control, and access to health care. which btw, sb5 shuts down places like Planned Parenthood where many women actually receive their medical care. Abortions are only 3-5% of their services. and to answer your “more education” question: just a broader sex education program in middle schools and high schools will help, maybe a week or two longer too.

Robert’s Rules of Order or some similar rule constrains debate on the floor. Every deliberative body has some rule for their process, the rules have to be followed.

          Wilson pledged neutrality in 1914 regarding WW 1, and Congress declared war in 1917 after Germany declared unrestricted warfare in war-zone waters, regardless of neutrality. Congress declared war in December of 1941 after the attack on Pearl Harbor. Congress also authorized Vietnam.

        Republicans later passed the Civil Rights act after the longest filibuster in Congress by Democrat Strom Thurmond who spoke against it for 24 hours 18 minutes. Teams of Democrat Senators filibustered the bill holding it up for 67 days.

Besides this, these babies can experience pain and fear the same as you and I. They have to endure literally being stabbed and dismembered. They have working brains, emotions, and feelings. If a child is going to die without a lung or kidney transplant, and the only match is the father, can we force him to donate? And if we’re not heartless, we might take into account the possibility that he’s making a choice to stay healthy and continue working so he can support his other children. Why would it be right to force a woman to donate her blood and tissue to a child who will die without it, but not to force a man to do the same?

    I am a Christian who is pro-choice because of my experience. I do not believe abortion should be birth control. I would love very much for people to have their babies not abort them. However it’s not always so simple. My first child was born without a brain at 24 weeks. I did not have an abortion I chose to have labor induced early. But abortion was an option given to me. My child would not have felt pain…she had no brain. She would not have survived no matter how long I carried her. My physical health was not in danger. If laws like this had been in place I would have been FORCED to carry my pregnancy to term. You have no idea what its like to have strangers approach you when you are visibly pregnant, ask you when you are due, and be very excited and happy for you when you know your child will not live. Emotionally I was a wreck. No politician was going to make a decision for my family. Not all babies live. There was no pro-life choice for me.

      I am so, so sorry for your loss. I too am a pro-choice Christian. I may not be able to see abortion as an option I would ever use, because I personally believe that life begins at conception. However, because my belief stems from my religious background, I also cannot support its being passed into law; that would force my belief on others who may not share it, by forcing them to carry babies to term which they may not have wanted or been prepared to care for. I am therefore, by default, pro-choice. I believe everyone’s choice whether or not to have an abortion should be personal, not dictated by politicians who are not, by and large, doctors.

      Thank you. I’m an adopted child. My birth mother was date raped at a young age. She was unprepared to be a mother. She made the choice to carry me to term. She had options and was given the choice and she made a choice. And I cannot possibly imagine for the life me having the government forcing her to do otherwise. And that is why I fight so hard to give women options, to make sure they have access to birth control, to healthcare. These regulations completely ignore the needs of the mother. The decision of what my mother would do requires options. To purely make it illegal would have made her a criminal. I certainly can’t imagine the government telling me what I can and cannot do with my body. And I certainly can’t imagine the government doing that to her or to any woman.

      Abortion is abhorrent. But making it illegal solves nothing. Making it unnecessary does.

    Reading most of these post just makes someone sad. A question to be asked is have you experienced this situation. Have you spent so many months with a baby in your tummy then come home to an empty tummy or an empty crib, because you find out that baby you have been dreaming about those big cartoon eyes those chubby cheeks doesn’t have a heart beat. Or be a woman who cannot carry a child because you and or the baby won’t survive the pregnancy or delivery. I can tell you it’s a very empty, very lost feeling. This bill in simple terms is about abortion, but the undermining terms is the control of a woman’s body. Government you are not paying my bills stop trying to control my lady parts.
