Planned Parenthood Sues Texas Over Women’s Health Program

The provider argues that excluding them from the program constitutes "discrimination by association."

Reproductive health care provider Planned Parenthood is suing the state of Texas over the state’s recent move to eliminate Planned Parenthood clinics from the Women’s Health Program.

Planned Parenthood sued Texas on Wednesday for excluding the group from participating in a program that provides contraception and check-ups to women.

The group contends in its lawsuit filed in Austin that a new state law banning organizations affiliated with abortion providers from participating in the Women’s Health Program amounts to unconstitutional discrimination by association.

“If enforced, the affiliate rule will cause irreparable harm to plaintiffs and to tens of thousands of low-income women seeking family planning and other preventive health services,” the suit alleges.

Texas lost millions in federal funding for the Women’s Health Program as a result of Governor Rick Perry’s decision to refuse to allow any funds to go to Planned Parenthood affiliates in the state.  Since then, at least 300,000 women have lost access to low- or no-cost preventive reproductive health care.
